I.Basicconditionsofemployer

　　一、用人單位基本條件

　　Theapplicantshallbeapartyandgovernmentorgan,publicinstitution,socialorganization,privatenonenterpriseunit,partnershipenterprise(accountingfirm,lawfirm,etc.)registeredintheadministrativeareaofthiscity,andshallcomplywiththeindustrialdevelopmentdirectionofthiscity,havearegisteredcapitalof1millionyuanormore,haveagoodreputation,operatenormallyinthiscity,paytaxesaccordingtolawAllkindsofenterprisesparticipatinginsocialinsuranceaccordingtoregulations(theregisteredcapitalofnonenterpriselegalpersonbranchesandtheirsuperiorlegalpersonsshallnotbelessthan1millionyuan).

　　申請單位應(yīng)是在本市行政區(qū)域內(nèi)注冊登記的具有用人自主權(quán)的黨政機(jī)關(guān)、事業(yè)單位、社會團(tuán)體、民辦非企業(yè)單位、合伙制企業(yè)（會計師事務(wù)所、律師事務(wù)所等）以及符合本市產(chǎn)業(yè)發(fā)展方向、注冊資金在100萬元人民幣及以上、信譽(yù)良好，并在本市正常經(jīng)營、依法納稅、按規(guī)定參加社會保險的各類企業(yè)（非企業(yè)法人分支機(jī)構(gòu)其上級法人注冊資金應(yīng)不低于100萬元人民幣）。

　　II.BasicconditionsforReturnedStudents

　　二、留學(xué)回國人員應(yīng)具備的基本條件

　　i.Theacademicdegreeobtainedbyreturnedstudentsshallmeetoneofthefollowingconditions

　　（一）留學(xué)回國人員獲得的學(xué)歷學(xué)位應(yīng)符合下列條件之一

　　1.Theaccumulatedstudytimeabroadisgenerallynotlessthan1yearafterobtainingthedoctor'sdegreefromoverseasuniversities;ForgraduatesofthenatureofSinoforeigncooperationinrunningschoolsandjointtraining,thecumulativestudytimeabroadisgenerallynotlessthanhalfayear.

　　1、國（境）外高校學(xué)習(xí)獲得博士學(xué)位，累計在外學(xué)習(xí)時間一般不少于1年；如為中外合作辦學(xué)、聯(lián)合培養(yǎng)等性質(zhì)畢業(yè)生，累計在外學(xué)習(xí)時間一般不少于半年。

　　2.Obtainfull-timebachelor'sdegree,bachelor'sdegreeoraboveindomestic"doublefirst-class"constructionuniversities(thepostgraduatetrainingunitsdirectlyunderthecentralgovernmentandtheChineseAcademyofSciencesrefertothe"doublefirst-class"constructionuniversities),andstudyinforeignuniversitiestoobtainamaster'sdegree;Orobtainfull-timebachelor'sdegree,bachelor'sdegreeoraboveindomesticnon"doublefirst-class"universities,andstudyinhigh-leveluniversitiesathomeandabroadtoobtainamaster'sdegree;Orstudyinforeignuniversitiestoobtainbachelor'sdegreeandmaster'sdegree.

　　2、在國內(nèi)“雙一流”建設(shè)高校獲得全日制本科、學(xué)士及以上學(xué)歷學(xué)位（中央直屬及中科院各研究生培養(yǎng)單位參照“雙一流”建設(shè)高校執(zhí)行），并在國（境）外高校學(xué)習(xí)獲得碩士學(xué)位；或在國內(nèi)非“雙一流”建設(shè)高校獲得全日制本科、學(xué)士及以上學(xué)歷學(xué)位，并在國（境）外高水平大學(xué)學(xué)習(xí)獲得碩士學(xué)位；或在國（境）外高校學(xué)習(xí)獲得學(xué)士學(xué)位和碩士學(xué)位。

　　3.Studyinhigh-leveluniversitiesabroadandobtainabachelor'sdegree.

　　3、在國（境）外高水平大學(xué)學(xué)習(xí)獲得學(xué)士學(xué)位。

　　4.Afterobtainingamaster'sdegreeoraboveinChinaorobtainingthequalificationforprofessionalandtechnicalpositionsatdeputyseniorlevelorabove,gotouniversitiesorscientificresearchinstitutionsabroadforfurtherstudyandbecomeavisitingscholarforatleastoneyear.

　　4、在國內(nèi)獲得碩士研究生及以上學(xué)歷學(xué)位或取得副高級及以上專業(yè)技術(shù)職務(wù)任職資格后，赴國（境）外高?；蚩蒲袡C(jī)構(gòu)進(jìn)修、做訪問學(xué)者等滿1年。

　　5.OthersdonotmeettheconditionsinItems2and3,butstudyinforeignuniversitiestoobtainabachelor'sdegreeormaster'sdegree.

　　5、其他不符合第2、3項條件，但在國（境）外高校學(xué)習(xí)獲得學(xué)士學(xué)位或碩士學(xué)位。

　　Theoverseasbachelor'sdegreereferredtoinItems2and3ofthisparagraphdoesnotincludetheformsofdomesticcollegestartingundergraduate,relevantnationalHigherEducationDiploma(HND),cooperativeschoolrunningandtransferofdomesticandplannedenrollment,andthecumulativelearningtimeabroadattheundergraduatestageisgenerallynotlessthan2years;Thecumulativestudytimeabroadatthemaster'sstageisgenerallynotlessthanhalfayear(excludingthecooperativeschoolrunningandtransfergradingformsofdomesticandoverseasenrollment);GraduatesofthenatureofSinoforeigncooperationinrunningschoolsandjointtrainingshallobtainbothdomesticacademicdegreesandoverseasdegrees.

　　本款第2、3項所指國（境）外學(xué)士學(xué)位，不含國內(nèi)大專起點(diǎn)本科、有關(guān)國家高等教育文憑（HND）、國內(nèi)計劃外招生的合作辦學(xué)及轉(zhuǎn)學(xué)分等形式，本科階段累計在外學(xué)習(xí)時間一般不少于2年；碩士階段累計在外學(xué)習(xí)時間一般不少于半年（不含國內(nèi)計劃外招生的合作辦學(xué)及轉(zhuǎn)學(xué)分等形式）；如為中外合作辦學(xué)、聯(lián)合培養(yǎng)等性質(zhì)畢業(yè)生，應(yīng)同時獲得國內(nèi)學(xué)歷學(xué)位和國（境）外學(xué)位。

　　Iftheoverseasbachelor'sdegreereferredtoinItem5ofthisparagraphisthehighestdegree,itdoesnotincludetheformsofdomesticcollegestartingundergraduatecourse,relevantnationalHigherEducationDiploma(HND),cooperativeschoolrunningandtransferpointsofdomesticandplannedenrollment,andthecumulativelearningtimeabroadattheundergraduatestageisgenerallynotlessthan2years.Ifthehighestdegreeisamaster'sdegree,theoverseasbachelor'sdegreemaynotbesubjecttotheaboverestrictions,andthecumulativestudytimeabroadatthemaster'sstageisgenerallynotlessthanhalfayear(excludingtheformsofcooperativeschoolrunningandtransferofstudentsenrolledoutsidethedomesticplan).

　　本款第5項所指國（境）外學(xué)士學(xué)位如為最高學(xué)位的，不含國內(nèi)大專起點(diǎn)本科、有關(guān)國家高等教育文憑（HND）、國內(nèi)計劃外招生的合作辦學(xué)及轉(zhuǎn)學(xué)分等形式，本科階段累計在外學(xué)習(xí)時間一般不少于2年。如最高學(xué)位為碩士的，國（境）外學(xué)士學(xué)位可不受前述限制，碩士階段累計在外學(xué)習(xí)時間一般不少于半年（不含國內(nèi)計劃外招生的合作辦學(xué)及轉(zhuǎn)學(xué)分等形式）。

　　Afterbeingadmittedbyforeignuniversities,ifyouhavestudyexperienceindomesticcampusesorbranches,theaccumulatedstudytimeandcreditsobtainedabroadaregenerallynotlessthan50%ofthetotalstudytimeandcredits;Afterbeingadmittedbycollegesanduniversitiesabroad,ifyouobtaincreditsthroughnonacademiceducationinChinathroughsummervacation,theaccumulatedcreditsobtainedabroadaregenerallynotlessthan80%ofthetotalcredits.

　　被國（境）外高校錄取后如在國內(nèi)校區(qū)或分校有就讀經(jīng)歷的，累計在外學(xué)習(xí)時間和獲得的學(xué)分一般不少于總學(xué)習(xí)時間和總學(xué)分的50%；被國（境）外高校錄取后如利用暑期等在國內(nèi)通過非學(xué)歷教育獲得學(xué)分的，累計在外獲得的學(xué)分一般不少于總學(xué)分的80%。

　　Domestic"doublefirst-class"universitiesshallbesubjecttothelistpublishedbythestate.Overseashigh-leveluniversitiespleasereferto（TimesHigherEducation）、（U.S.News&WorldReport）、（QuacquarelliSymondsWorldUniversityRankings）、（ShanghaiRanking’sAcademicRankingofWorldUniversities）Thelistoftheworld'stop500universitiespublishedshallbesubjecttothelistissuedafterconfirmationbyShanghaihumanresourcesandSocialSecurityBureau.

　　國內(nèi)“雙一流”建設(shè)高校以國家公布的名單為準(zhǔn)。國（境）外高水平大學(xué)參考英國泰晤士報高等教育副刊（TimesHigherEducation）、美國新聞與世界報道（U.S.News&WorldReport）、QS世界大學(xué)排名（QuacquarelliSymondsWorldUniversityRankings）、上海軟科世界大學(xué)學(xué)術(shù)排名（ShanghaiRanking’sAcademicRankingofWorldUniversities）發(fā)布的世界排名前500名高校名單，以上海市人力資源和社會保障局確認(rèn)后發(fā)布的為準(zhǔn)。

　　ThenameoftheinstitutionissuingthedegreecertificatespecifiedinthecertificateofforeignacademicdegreeissuedbytheMinistryofeducationshallprevailiftheoverseasstudentsstudyabroadtoobtainthedegree.

　　留學(xué)人員在國（境）外學(xué)習(xí)獲得學(xué)位的院校以教育部出具的國外學(xué)歷學(xué)位認(rèn)證書中載明的頒發(fā)該學(xué)位證書的院校名稱為準(zhǔn)。

　　ii.ReturnedstudentswhoapplyforpermanentresidenceinShanghaishallmeetthefollowingconditionsatthesametime

　?。ǘ┝魧W(xué)回國人員申辦上海常住戶口同時應(yīng)符合下列條件

　　1、Studentsstudyingabroadshallcometothecityandcontinuetoworkinthecitywithin2yearsafterreturninghome,signlabororemploymentcontractswithrelevantemployersinthecityaccordingtolaw,andpaysocialinsurancepremiumsandindividualincometaxinthecityaccordingtoregulations(exceptthosemeetingthefirstparagraphofincentiveconditions).

　　1、留學(xué)人員應(yīng)在回國后2年內(nèi)來本市并持續(xù)在本市工作，與本市相關(guān)用人單位依法簽訂勞動或聘用合同、按規(guī)定在本市繳納社會保險費(fèi)和個人所得稅（符合激勵條件第一款的除外）。

　　2、Forthosewhomeetthefirstfourconditionsofthefirstparagraphofthisarticle,thesocialinsurancecontributionbaseinthesameunitforthelastsixconsecutivemonthsshallnotbelowerthantheaveragewageofemployeesinurbanunitsinthecityinthepreviousyear,andthepaymentofindividualincometaxshallbereasonablycorrespondingtothesocialinsurancecontributionbase;ForthepersonnelwhomeettheconditionsinItem5ofparagraph1ofthisarticle,thesocialinsurancepaymentbaseinthesameunitforthelast12consecutivemonthsshallnotbelessthan1.5timestheaveragewageoftheemployeesinurbanunitsinthecityinthepreviousyear,andthepaymentofindividualincometaxshallbereasonablycorrespondingtothesocialinsurancepaymentbase.Theannualpaymentbaseofsocialinsuranceduringthetransitionperiodshallbesubjecttotheofficialfigures.

　　2、符合本條第一款前4項條件的人員，最近連續(xù)6個月在同一單位社會保險繳費(fèi)基數(shù)不低于上一年度本市城鎮(zhèn)單位就業(yè)人員平均工資，個人所得稅繳納情況與社會保險繳費(fèi)基數(shù)合理對應(yīng)；符合本條第一款第5項條件的人員，最近連續(xù)12個月在同一單位社會保險繳費(fèi)基數(shù)不低于上一年度本市城鎮(zhèn)單位就業(yè)人員平均工資的1.5倍，個人所得稅繳納情況與社會保險繳費(fèi)基數(shù)合理對應(yīng)。社會保險繳費(fèi)基數(shù)過渡期內(nèi)每年的繳費(fèi)基數(shù)以官方對外公布的數(shù)字為準(zhǔn)。

　　Inprinciple,thesocialinsurancepaymentbase,periodandindividualincometaxpaymentareautomaticallycomparedbythesystem;Ifthesocialinsurancepremiumisnotpaidnormally,thepayerisinconsistentwiththeunitsigningthecontract,thethirdpartysuchasthenonactualemployerisentrustedtopay,andthesocialinsurancepaymentbasecannotreasonablycorrespondtothepaymentofindividualincometax,itshallnotberecognized.

　　社會保險繳費(fèi)基數(shù)、期限及個人所得稅繳納情況原則上由系統(tǒng)自動比對；未正常繳納社會保險費(fèi)而補(bǔ)繳的、繳費(fèi)單位與簽訂合同單位不一致的、委托非實(shí)際用人單位等第三方繳納的、社會保險繳費(fèi)基數(shù)與個人所得稅繳納情況不能合理對應(yīng)的不予認(rèn)可。

　　3、Returnedoverseasstudentsshallbetalentswhoareinshortsupply,urgentlyneedtoplayanimportantroleandneedtobeusedforalongtime.Theyshallsignalabororemploymentcontractwiththeunitaccordingtolaw.Thecontractshallbevalidfor2yearsormoreandshallbevalidfor3monthsormorefromthedateofonlineacceptance(ifthecontractstipulatesaprobationperiod,theycanapplyaftercompletingtheprobationperiod);Inprinciple,dispatchedpersonneldonotbelongtothescopeofbid.

　　3、留學(xué)回國人員應(yīng)為單位緊缺急需并發(fā)揮重要作用、需長期使用的人才，與單位依法簽訂勞動或聘用合同，合同有效期在2年及以上，且自網(wǎng)上受理之日起有效期在3個月及以上（如合同約定有試用期的，需完成試用期后方可申報）；派遣人員原則上不屬于申辦范圍。

　　4、Lessthanthelegalretirementageformorethanfiveyears

　　4、年齡距法定退休年齡5年以上。

　　5、InlinewiththecurrentfamilyplanningpoliciesofthestateandthisMunicipality.

　　5、符合國家及本市現(xiàn)行計劃生育政策。

　　6、NocriminalrecordandothercircumstancesthatarenotsuitableforapplyingforpermanentresidenceinShanghai.

　　6、無刑事犯罪記錄等不宜申辦上海常住戶口的情形。
